Conditional Release Order and No Conviction for Domestic Violence Assault

Our solicitor Mr Andrew Carr represented a 40-year-old man in the Local Court who had been charged with Assault Occasioning Actual Bodily Harm (Domestic Violence Related).

The police alleged that the man had hit his son with a shoe causing actual bodily harm.

Despite our client’s own admissions, Mr Carr made representations to the police that the prosecution would have difficulty proving that any injury sustained by our client’s son was capable of amounting to actual bodily harm.  Mr Carr also made representations in regards to having the police facts amended.

As a result of the representations made by Mr Carr, the prosecutor withdrew the charge of with Assault Occasioning Actual Bodily Harm (Domestic Violence Related) and a charge of Common Assault (Domestic Violence Related) was laid.  The male was placed on a Conditional Release Order (CRO) without conviction for a period of two years.

That result was achieved by our Mr Carr drafting lengthy written representations to the prosecutor with respect to charge negotiations and making extensive oral submissions to the court at sentence.

This case illustrates the importance of quality representation and the value of a solicitor like Andrew Carr who cares for his client’s circumstances and will work hard to ensure their case is prepared and presented in a way that ensures the Court gives full effect to every factor in a client’s favour.

As you had to be in Cessnock soon after my case was dealt with, I didn’t have time to fully express my thanks to you for your wonderful work in representing me at Court. Your thorough professionalism and knowledge of effective preparation and procedure resulted in a great outcome for me - one that I dared not hope for at the beginning. I will thoroughly recommend you to others who need legal representation. Best wishes to you and your family in the future. Thank you once again.

Excellent representation and the best outcome I could have asked for. Went to court for a driving while suspended charge and Andrew Carr was fantastic during the whole ordeal. Not only was the fine waived, but more importantly I was able to keep my license and stay on the road.
