License Suspension Reversed and Costs Order Made in Client's Favour

Our solicitor Anne Ford represented a client charged with driving whilst suspended.

The client had a serious medical condition which had been managed over many years by their primary medical specialist. The client had visited a new medical specialist a few months prior to the charge.

The client was stopped by police and told that their driver’s licence had been suspended by the Department of Transport a few weeks earlier on medical grounds. Police impounded our client’s vehicle and summonsed them to appear in the Magistrates Court for the alleged offence.

On Ms Ford's advice, the client booked an appointment to see their regular treating specialist to re-assess their medical condition. The specialist completed a Medical Assessment Certificate Fitness to Drive Certificate and submitted the document to the Department of Transport.

After approximately one month our client received a letter from the Department of Transport advising that following the medical assessment they had been found to be medically fit and that the suspension had been reversed. The matter was subsequently discontinued by the court.

In accordance with her instructions, Ms Ford also sought costs associated with the impoundment of our client’s vehicle and for some of his legal fees.

Costs were awarded to our client in the amount of $2,000.00.

Community Based Order For Drug Offences

Our solicitor Anne Ford successfully represented a man who was charged with several drug offences, one of which was Cultivating a Prohibited Plant With Intent to Sell or Supply (499 grams of cannabis).

After extensive negotiations with WA Police Prosecutions Unit and the Investigating Officer our client was spared a jail term and was sentenced to a Community Based Order for a total of 1 year, with no fine or costs ordered by the court.

Anne was able to achieve an excellent outcome for her client in this matter.

Extraordinary Driver’s License For Drink Driving Client

Our solicitor Anne Ford successfully represented a man charged with driving with a BAC of 0.08%. The client received the minimum fine, a loss of license backdated to the Police Roadside Disqualification date and Court Costs. Six weeks later Ms Ford succeeded in obtaining a court order which allowed our client to be granted an Extraordinary Driver’s License.

The client was a young father who had recently started up his own business.  Without a license he would not have been able to work, financially provide for his family and would have had to sell his business. The client’s business was dependent upon him having a license to get to and from work and throughout the course of his day.  On this basis, supported by evidence, Ms Ford submitted to the court that the client should receive an Extraordinary Driver’s Licence. He was back on the road within 6 weeks of his drink driving conviction.

Great Outcome For Client on Driving Charges

Our solicitor Anne Ford successfully represented a man charged with Providing False or Misleading Personal Details contrary to the Road Traffic (Administration) Act and driving with No Authority to Drive contrary to the Road Traffic Act.

After Anne made submissions to the Court, the client received a small fine, a license disqualification and a Spent Conviction. Had the client not received a Spent Conviction, he would have not been able to continue in his employment due to having a disclosable conviction against his name.
