Our solicitor Jona Villanueva represented a 48-year-old for a breach of alcohol interlock condition charge, by starting the vehicle in a way other than by the person blowing directly into the appropriate part of the approved alcohol interlock.
The case involved obtaining medical material to support that our client’s blood alcohol limit could be impacted by consuming certain food products, due to their existing medical conditions. Furthermore, our solicitor reviewed the Brief of Evidence, guidelines of the interlock conditions, and held discussions with the Prosecution.
Our representation and submissions to Prosecution resulted in the withdrawal of the charge laid against our client. This was achieved by providing the Prosecution with medical material and making submissions with respect to both the legislation and the Guidelines provided by the interlock supplier. These stated that the motor vehicle fitted with the interlock device will operate if the driver blows a BAC level below 0.02.
This case illustrates that with quality representation, a charge can be withdrawn by Prosecution with a sufficently well-prepared case brief. Our solicitor Jona Villanueva represented a 34-year-old at the Werribee Magistrates Court on 18 October 2017 in relation to the following charges:
- Intentionally causing injury;
- Recklessly causing injury;
- Unlawful assault with a weapon; and
- Unlawful assault.
The case involved an offence that was committed from an altercation at a licensed venue in Werribee. The accused was charged with the offences as the victim suffered minor injuries to his skull and the Police believed there was a weapon involved.
Our representation in Court resulted in the withdrawal of the first three charges and the accused being sentenced to an Undertaking of Good Behaviour on the charge of unlawful assault.
This was achieved by preparing for the case thoroughly and the successful summary case conference with Prosecution on the day of Court. It was argued that the victim’s injuries did not correlate to a weapon being used. Furthermore, the minor injury sustained by the victim was not from a reckless behaviour by the accused.
