Samira holds a Bachelor of Laws and a Bachelor of Science (Psychology) from the University of Wollongong. She also has a Masters of Dispute Resolution from the University of Technology Sydney and has completed a Graduate Diploma in Legal Practice.
Samira is admitted as a solicitor in New South Wales (NSW) and while she practices in NSW, she is highly experienced in such Australian Federal Law areas as Family Law and Consumer Law.
Samira is an experienced solicitor in the areas of Traffic Law, DUI, Criminal Law and Family Law. She has also presented the legal component as a volunteer at many Traffic Offenders Intervention Programs and dedicates her spare time educating others when new traffic legislation becomes effective. Samira loves to mentor newly-admitted solicitors and is always ready to provide additional assistance to her clients.

    Conviction Quashed on Appeal for Stealing From Employer

    Our solicitor Samira Ashkar represented a 24-year-old woman in the District Court in Parramatta in relation to a charge of Steal Property as Clerk/Servant.

    This case involved a serious breach of trust by an employee against her employer. Our client had worked in a bar and had falsified refunds from patrons and pocketed the money for herself. Our client’s conduct was enough to alert her employer and resulted in being charged by the Police. In the Local Court, she was unrepresented and was convicted by the Magistrate. She then attended our office to seek our representation for an appeal in the District Court.

    Our representation resulted in the District Court upholding our appeal and setting her conviction aside. She was instead placed on a two-year good behaviour bond pursuant to Section 10 (1)(b) of the Crimes (Sentencing Procedure) Act 1999 (NSW).

    This result was achieved by preparing a case that reflected a holistic approach to why this offence was a terrible mistake by our client and that she deserved a chance to prove it was a one-off aberration. This case illustrates the importance of quality representation and the value of a solicitor like Samira Ashkar who will always fight for her clients and do everything she can to ensure their case is prepared and presented thoroughly before the court.
