Parenting Orders Made For Extra Time With Father

Our solicitor Serena Vos represented a father who was seeking parenting orders prior to the mother going overseas with the children. Prior to our engagement, the parties had been to Mediation and had agreed to a parenting plan which had been in effect for some time.

The mother was alleging that the child was experiencing anxiety as a result of the time she spent with the father. The mother had been taking the child to a therapist to address the anxiety without a formal diagnosis and without the consent of the father. The mother was also seeking to reduce the father’s time with the child substantially.

Ms Vos advised the father to seek parenting orders by consent and liaised with the mother’s solicitor. No agreement was reached and the mother initiated court proceedings.

Ms Vos assisted the father in contesting the mother's application and obtained orders formalising the existing parenting plan with the addition of orders for the child to spend extra time with the father and to communicate with the father via telephone or facetime.

The court made orders in the terms sought by our client.

Father Receives Parenting Orders in the Terms He Sought

Our solicitor Serena Vos represented the father in a family law matter. The client had not seen the children for over one year.

Prior to our engagement, the children’s mother had withheld the children from the client and he was attempting to negotiate matters with her directly without success.

The mother had also made allegations of substance abuse and family violence against our client.

Ms Vos assisted the client by initiating court proceedings to seek parenting orders for him to spend time with the children. In the time before the court date, the mother moved interstate with the children and our client did not know where the children were.

Ms Vos sought a recovery order and the Australian Federal Police located the children and they were returned to Victoria. Ms Vos then sought orders for the children to live with the father and provided evidence that this was in the children’s best interest.

The court made the orders sought.

Being able to gain some initial advice on the phone and then being able to book someone for the same day for an hour was fantastic. We were not pressured to front up with a heap of money and were given the option on whether or not to engage them. We were able to make decisions and they were happy to inform us of the process and encouraged us to handle the areas that we could ourselves to help reduce cost.

My Lawyer was very professional and considerate when seeing for the first time. Although I can't afford a private Lawyer at this time I have found a way. Because the stress I was under was far too much for me to take on alone while trying to start a new life with my 5 children. I highly recommend this company!
