Final Orders in Favour of Grandparent

Our solicitor Brandon Begley was retained by a client in relation to Family Law proceedings (Parenting). This matter involved the client's very young grandchildren who had learning difficulties.

The client had shared a very close relationship with the children from birth and assisted in all aspects of caring for the children.

After attempting to engage in a Family Dispute Resolution Conference, the parent fled the state with the children. There were significant safety concerns in relation to the children remaining with the parent, including drug use, violence and mental illness.

The client instructed Mr Begley to commence urgent proceedings in the Federal Circuit Court of Australia. We succeeded in obtaining a Location Order to locate the parent and children, and then a Recovery Order to retrieve the children.

Mr Begley obtained Final Orders granting our client parental responsibility and Orders that the children live with the Grandparent, avoiding the need to attend a Final Hearing.

Recovery Order Obtained Ex Parte

Our solicitor Brandon Begley assisted a client in a Family Law matter involving two young children. The other party had withheld the children for several months.

Brandon Begley was instructed to commence urgent proceedings in the Federal Circuit Court of Australia and was successful in obtaining an urgent listing and a Section 60i (Family Dispute Resolution Conference) exemption.

The other party was allowing the children to be exposed to an individual who placed the children at an unacceptable risk of harm (due to drug use, and dangerous and violent behaviour).

Mr Begley made submissions for the matter to be heard ex parte (without the other party being present) and successfully obtained a Recovery Order for the children and injunctions to protect them from being exposed to this individual.
